NEWS BRIEF
The Denver Gazette reports that Denver District Court Judge Heidi Kutcher ruled that Amendment 87, a proposed graduated income tax measure, can remain on Colorado’s November ballot. The ruling rejected claims that issues involving paid petition circulator registration and training required signatures to be invalidated.
The legal challenge is continuing. The plaintiff’s attorney said he plans to seek an expedited appeal to the Colorado Supreme Court as the election approaches. Voters would decide whether to replace the state’s flat income tax structure with a graduated system under the proposal.
What to know
A Denver judge allowed Amendment 87 to stay on the ballot after finding the plaintiff had not established a legal basis to invalidate signatures. An expedited appeal to the Colorado Supreme Court is planned, so the dispute is not yet resolved.
